2. Information and Terminologies
Our website https://ledone.eco/ (hereinafter “Website”) as well as the portals titled and managed by the organization, use a technology called “cookies” to collect information about the use of the Website, according to the provisions of article 22 of the LSSI.
Cookies are small files that web pages, online stores, intranets, online platforms or similar store in the browser of the user who visits them, allowing the retrieval of already stored information and providing countless advantages for web navigation in the delivery of interactive services, as well as providing relevant information to the Website owner.
3. Typological Classification of Cookies
The following classification of possible types of Cookies, offered as guidance since they are the most common, helps to better understand the functions they perform:
3.1. Types of Cookies according to the entity that manages them
Depending on who is the entity that manages the device or domain from which the cookies are sent and processes the data obtained, we can distinguish:
a) Own cookies:
These are those sent to the user’s terminal device from a device or domain managed by the publisher itself and from which the service requested by the user is provided.
b) Third-party cookies:
These are those sent to the user’s terminal device from a device or domain that is not managed by the publisher, but by another entity that processes the data obtained through the cookies.
If the cookies are served from a device or domain managed by the publisher but the information collected by them is managed by a third party, they cannot be considered own cookies if the third party uses them for its own purposes (for example, improving the services it provides or providing advertising services on behalf of other entities).
3.2. Types of Cookies according to their purpose
There are many purposes for the use of cookies. According to the purpose for which the data obtained through cookies is processed, some of the purposes may be:
a) Technical cookies:
These allow the user to navigate through a web page, platform or application and use the different options or services that exist therein, including those that the publisher uses to allow management and operation of the website and enable its functions and services, such as controlling traffic and data communication, identifying the session, accessing restricted areas, remembering the items in an order, completing the purchase process of an order, managing payment, controlling fraud related to service security, requesting registration or participation in an event, counting visits for licensing software usage billing (website, platform or application), using security elements during navigation, storing content for video or audio broadcasting, enabling dynamic content (e.g., animation of loading text or images) or sharing content through social networks.
Also, due to their technical nature, those cookies that allow the management, as efficiently as possible, of advertising spaces that, as an element of design or “layout” of the service offered to the user, the publisher has included on a web page, application or platform based on criteria such as the edited content, without collecting user information for other purposes like personalizing that advertising content or other contents.
Technical cookies will be exempted from the obligations established in article 22.2 of the LSSI when they allow providing the service requested by the user, as is the case with the cookies listed above. However, if these cookies are also used for non-exempt purposes (e.g., behavioral advertising), they will be subject to such obligations.
b) Preference or personalization cookies:
These allow remembering information so that the user accesses the service with certain characteristics that can differentiate their experience from that of other users, such as language, number of results to show when the user performs a search, the appearance or content of the service depending on the type of browser through which the user accesses the service or the region from which the user accesses the service, etc.
If the user chooses these characteristics themselves (for example, selecting the language of a website by clicking on the corresponding country’s flag icon), the cookies will be exempt from the obligations of article 22.2 of the LSSI as they are considered a service expressly requested by the user, provided the cookies exclusively comply with the selected purpose.
c) Analytical or measurement cookies:
These allow their owner to track and analyze the behavior of users of the websites to which they are linked, including quantifying the impact of advertisements. The information collected through these cookies is used to measure the activity of websites, applications or platforms, in order to introduce improvements based on the analysis of the usage data made by the users of the service.
Regarding the processing of data collected through analytical cookies, the GT29 stated that although they are not exempt from the duty to obtain informed consent for their use, it is unlikely that they pose a risk to users’ privacy as long as they are first-party cookies that process aggregated data for strictly statistical purposes, that information about their uses is provided, and that users have the option to refuse their use.
d) Behavioral advertising cookies:
These store information about users’ behavior obtained through continuous observation of their browsing habits, which allows developing a specific profile to show advertising based on it.
3.3. Types of Cookies according to the duration they remain active
According to the duration they remain active on the terminal device, we can distinguish:
a) Session cookies:
These are designed to collect and store data while the user accesses a web page. They are usually used to store information that only needs to be kept for the provision of the service requested by the user on one occasion (for example, a list of purchased products) and disappear when the session ends.
b) Persistent cookies:
These are those in which the data remains stored on the terminal and can be accessed and processed for a period defined by the cookie owner, which can range from a few minutes to several years.
